Terms and Conditions

Platform: TradingRadar (the “Platform”)
Operator: TradingRadar (“we”, “our”, “us”)

1. Acceptance of Terms

These Terms and Conditions (“Terms”) constitute a binding legal agreement between TradingRadar and each User (“User”, “Subscriber”, “You”). By accessing, registering, subscribing, or otherwise using the Platform, You irrevocably acknowledge that You have read, understood, and agreed to these Terms in their entirety. If You do not accept these Terms, You must immediately cease all access and usage.

2. Scope of Services

The Platform provides software-as-a-service (SaaS) features including, without limitation, artificial intelligence–driven analytics, dashboards, reports, visualizations, alerts, and related tools.
- All services are strictly educational and informational.
- TradingRadar is not a SEBI-registered advisor, analyst, portfolio manager, or intermediary.
- Nothing provided constitutes financial advice, solicitation, or inducement.

3. Eligibility

• You must be at least 18 years of age and legally competent to contract.
  
• By creating an account, You warrant full legal capacity under Indian law.

4. Account Creation and Security

• User accounts are personal, unique, and non-transferable.
  
• You are solely responsible for protecting login credentials.
  
• Any unauthorized access arising from negligence shall not create liability for TradingRadar.
  
• Suspected breaches must be reported immediately to rj.litigation@gmail.com.

5. Subscription, Renewal, and Expiry

• Subscription activates only upon full and confirmed payment.
  
• Subscription is strictly personal, non-transferable, non-assignable, and non-sublicensable.
  
• Subscriptions terminate automatically at the end of the prepaid term unless renewed.
  
• TradingRadar reserves the right to suspend or terminate accounts for breach, fraud, or misuse.

6. Payments

• Payments must be made exclusively through authorized payment gateways.
  
• All applicable taxes, levies, or charges are borne by the User.
  
• TradingRadar disclaims liability for declines, delays, or rejections by third-party processors.

7. Refund Policy

• Subscriptions are non-refundable once activated.
  
• Refunds are limited to:
  1. Duplicate payments;
     
  2. Failed transactions where service is not activated despite debit;
     
  3. Proven technical error solely attributable to TradingRadar.
     
• Refunds, if approved, are processed strictly to the original mode of payment within nine (9) to fourteen (14) working days.
  
• Refunds shall not be granted for dissatisfaction, change of mind, or interruptions beyond our control.

8. Cancellation Policy

• Subscriptions expire automatically at the end of their prepaid term.
  
• Mid-term cancellations are not permitted.
  
• Non-renewal results in automatic cessation of access.
  
• No partial or pro-rata refunds shall be issued.

9. Intellectual Property

• All software, algorithms, databases, dashboards, trade names, trademarks, service marks, brand assets, and designs are the exclusive property of TradingRadar.
  
• You are granted only a limited, revocable, non-exclusive license to access and use the Platform.
  
• Unauthorized reproduction, reverse engineering, framing, scraping, or derivative use is expressly prohibited.

10. Acceptable Use

You agree not to:
- Use the Platform for unlawful, fraudulent, abusive, or harmful purposes.
- Introduce malware, overload systems, or attempt unauthorized access.
- Share, resell, or sublicense subscriptions.
Violation of this clause constitutes material breach and permits immediate termination without refund.

11. Privacy and Data Protection

• Data collection, retention, and processing are governed by the Privacy Policy.
  
• By using the Platform, You consent to lawful collection and processing of limited personal data.
  
• TradingRadar employs industry-standard encryption, but You acknowledge residual risks inherent in internet transmissions.

12. Disclaimer of Warranties

• The Platform is provided strictly “as is” and “as available.”
  
• No warranties, express or implied, are made regarding accuracy, merchantability, fitness for purpose, or uninterrupted availability.

13. Limitation of Liability

• TradingRadar shall not be liable for indirect, incidental, consequential, punitive, or exemplary damages.
  
• Aggregate liability, whether in contract, tort, or otherwise, shall not exceed the subscription fees paid by the User in the twelve (12) months immediately preceding the claim.

14. Indemnity

You agree to indemnify, defend, and hold harmless TradingRadar, its officers, employees, affiliates, and licensors against all claims, damages, liabilities, losses, or expenses arising from:
- Your breach of these Terms;
- Misuse of the Platform;
- Violation of applicable laws or third-party rights.

15. Force Majeure

TradingRadar shall not be liable for any failure, delay, or interruption caused by circumstances beyond reasonable control, including natural disasters, cyber-attacks, outages, strikes, governmental actions, or technical breakdowns.

16. Compliance with Laws

Users shall comply with all applicable laws, regulations, and guidelines while using the Platform. TradingRadar may suspend accounts if continued service risks legal non-compliance.

17. User Representations

By subscribing, You represent and warrant that:
- You shall not rely upon the Platform as sole basis for financial decisions.
- You have independent judgment and, where necessary, professional financial advice.
- You will not use the Platform to mislead third parties or repackage its outputs as advisory services.

18. Amendments

TradingRadar reserves the unilateral right to amend, revise, or replace these Terms at its discretion. Continued usage after modifications constitutes binding acceptance.

19. Severability

If any provision is held invalid or unenforceable, the remaining provisions shall remain fully effective.

20. Waiver

Failure by TradingRadar to enforce any right or provision shall not constitute waiver of that right or provision.

21. Governing Language

These Terms are drafted in English and shall prevail over translations.
